The Association for Child Development (ACD) is responsible for formally investigating seriously deficient Providers. All Worksheet/Menu recording issues in excess of six days (or multiple offenses) are considered serious deficiencies. Other serious deficiencies include, but are not limited to:

  • Submission of false information on the Site Information Sheet;
  • Submission of false information on menus and meal attendance sheets (Worksheets/Menus);
  • Submission of false information on Child Registration Letters;
  • Participation under more than one sponsor simultaneously;
  • Not meeting the meal patterns and/or infant meal patterns as supplied by the USDA;
  • Failure to maintain records;
  • Having existing conditions in the home that threaten the health or safety of a child in care, or the health and safety of the public;
  • Criminal conviction in the past seven years and/or lack of business integrity. Included are: fraud, antitrust violations, embezzlement, theft, forgery, bribery, falsification, or destruction of records;
  • Any other circumstance that is related to nonperformance under the Child and Adult Care Food Program Provider/Sponsoring Organization Agreement.

    Examples of nonperformance issues may include, but are not limited to:
    • Refusing to allow ACD, the Illinois State Board of Education (ISBE), and other state and federal officials the right to visit the Provider’s home to observe meal/snack service and review records during the hours of child care operation.
    • Failure to participate in training.
    • Consistent pattern of unavailability during an unannounced or announced Home Review.
    • “Block claiming” attendance for day care children. Block claiming is defined as the number of meals claimed for one or more meal type (breakfast, lunch, snack, or supper) is identical for 15 consecutive days within a claiming period.
    • Claiming “ghost” or fictitious children on the CACFP.

Second offenders (Providers who have been found to be seriously deficient and who have submitted an approved Corrective Action Plan) who repeat the same serious deficiency (for one or more days) will receive an Intent to Terminate letter. Serious deficiency history will remain with Providers throughout the duration of their ACD sponsorship.
